How to Take Title to Land

Admin
February 27, 2026

When you buy property, you must decide how you will take title.

Taking title simply means how ownership is legally held.

This article is not legal advice. It is a general overview of common ways title can be held. Laws vary by state. If you have questions after reading this we encourage you to speak with a qualified real estate attorney before deciding.

Here are the most common options.

Sole Ownership

Sole ownership means one person owns the property.

If you are unmarried, this is usually simple. You own 100 percent of the property.

If you are married, ownership rules may depend on when and how the property was purchased. State laws differ, so legal guidance is important if you want the property in one spouse’s name only.

Community Property

Some states follow community property laws.

In those states, property purchased during marriage using shared funds is generally owned equally by both spouses.

Not all states use this system. Because rules vary, confirm how your state handles marital property.

Joint Tenancy

Joint tenancy allows two or more people to own property together.

Each owner holds an equal interest. Most joint tenancies include rights of survivorship. This means if one owner passes away, their share automatically transfers to the remaining owner.

Tenants in Common

Tenants in common also allows multiple owners.

Ownership shares do not have to be equal. Unlike joint tenancy, there is usually no automatic transfer upon death. An owner’s share passes according to their will or state law.

Tenancy by the Entirety

This option is available to married couples in some states.

Both spouses own the property together, and one cannot sell without the other’s consent. It typically includes survivorship rights.

Why This Matters

How you take title affects ownership rights, inheritance, and long term planning.

This overview is for educational purposes only. Because laws vary by state and situation, if you have additional questions speak with a qualified attorney before making a decision.
